Terms of Service.

Notice — not a consumer reporting agency
PeopleProbe is not a consumer reporting agency as defined by the U.S. Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.), and nothing it produces is a consumer report. You may not use the Service, or any report it generates, to determine a person's eligibility for employment, housing or tenancy, credit, insurance, or any other purpose that would require a consumer report or a consumer reporting agency. That use is prohibited absolutely, whatever your jurisdiction.
1. Agreement
These Terms of Service govern your use of PeopleProbe (the “Service”), operated by PeopleProbe (“we”, “us”). By creating an account or using the Service you accept these Terms. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it, and “you” includes that organisation.
2. What the Service is
PeopleProbe is a research tool. It gathers publicly available information — company registries, court and regulatory records, sanctions and watchlists, press coverage, academic and professional records, and comparable open sources — and assembles it into a structured, evidence-graded report on a named subject. The Service reports what the public record shows; it does not access private databases, credit files, or non-public personal information.
3. Permitted purposes
The Service may be used only for lawful investigative purposes, namely:
- Know-your-customer and anti-money-laundering compliance;
- Investor, counterparty, vendor, and transaction due diligence;
- Fraud investigation and asset tracing on lawful grounds;
- Journalism and research in the public interest;
- Personal security assessments concerning your own dealings;
- Other investigative purposes permitted by applicable law.
Each search requires you to state its purpose. That statement is recorded with the investigation and appears on the report. A false statement of purpose is a material breach of these Terms.
4. Prohibited uses
You must not use the Service or its reports:
- For any FCRA-regulated purpose. Not to evaluate a person for employment, promotion, reassignment, or retention; not to screen tenants or applicants for housing; not to assess eligibility for credit or insurance; and not for any purpose for which the law requires a consumer report. PeopleProbe does not and will not operate as a consumer reporting agency.
- To stalk, harass, intimidate, or threaten any person, or to locate a person in order to harm them;
- To discriminate against any person on the basis of a protected characteristic;
- To make automated decisions producing legal or similarly significant effects on a data subject without a lawful basis;
- In violation of any applicable law, including data-protection, privacy, and anti-discrimination law in your jurisdiction;
- To resell, sublicense, or systematically redistribute reports or the data within them as a standalone product;
- To probe, scrape, overload, or reverse-engineer the Service itself.
We may suspend or terminate accounts we reasonably believe are in breach of this section, and we cooperate with lawful requests from authorities concerning misuse.
5. Accounts and credits
You must provide accurate account information and keep your credentials secure. Investigations are paid for in credits, purchased in packs. Credits are reserved when an investigation is confirmed; unspent reserves are returned when it completes. Credits are not redeemable for cash and, except where the law requires otherwise, purchases are final once an investigation has consumed them. Where an investigation fails through fault of the Service, the reserved credits are refunded in full.
6. Accuracy, evidence grades, and no warranty
Public records contain errors, omissions, and namesakes. Every finding in a PeopleProbe report carries an evidence grade — verified, likely, unverified, contradicted, or fabrication suspected — and the grade is part of the finding. A report is an assessment of what the public record showed at the time of the search; it is not a warranty of any fact about the subject, and it is not legal, financial, or professional advice. You are responsible for independently verifying any finding before acting on it. The Service is provided “as is” and “as available”, without warranties of any kind, express or implied.
7. Data subjects
A person who is the subject of a PeopleProbe report may contact us at privacy@probepeople.com to ask whether we hold research output concerning them, to contest the accuracy of a finding, or to request deletion of report data we store, subject to our legal obligations and our customers' legitimate retention interests. We respond to such requests within thirty days. Our Privacy Policy describes this in full.
8. Confidentiality of reports
Reports are prepared for the account that commissioned them. You may share a report within your organisation and with your professional advisers for the stated purpose. Publishing a report, or extracts of it, is your decision and your responsibility, including for its accuracy and lawful use in context.
9. Intellectual property
We retain all rights in the Service, its software, design, and report formats. You receive a non-exclusive licence to use the reports you commission for the stated lawful purpose. Public records themselves belong to no one; our arrangement, analysis, and grading of them belong to us.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for decisions you or others make in reliance on a report. Nothing in these Terms excludes liability that cannot be excluded by law.
11. Indemnity
You will indemnify us against claims arising from your breach of these Terms, including any use of the Service or its reports for a prohibited purpose.
12. Termination
You may close your account at any time. We may suspend or terminate access for breach of these Terms. Unused purchased credits are refunded on termination except where the breach involves a prohibited use, in which case they are forfeit to the extent the law allows. Sections 4, 6, 8, 10, and 11 survive termination.
13. Changes
We may revise these Terms. Material changes are notified by email or in the product at least fourteen days before they take effect; continued use after that date is acceptance. The current version is always at this address.
14. Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts, save that either party may seek injunctive relief in any competent court and consumers retain any mandatory protections of their home jurisdiction.
